Cupertino has 21 days to appeal the decision by Colin Birss

Judge Colin Birss has ruled in a British court today that Samsung’s tablets are simply not cool enough for Apple to claim they infringe on design patents owned by the Cupertino, California-based giant.

“(Samsung's tablets) do not have the same understated and extreme simplicity which is possessed by the Apple design,” Birss said in the ruling. “They are not as cool.”

The not-as-cool thing, of course, is something the Judge simply threw in to emphasize that Samsung can continue to sell their tablets, after expert eyes analyzed the two tablet models from every possible standpoint. Apple has 21 days to appeal the decision issued this week.

It is worth noting that U.S. District Court Judge Lucy Koh earlier ruled that Samsung did infringe on Apple's design patents, stating that the Korean gadgets maker “does not have a right to compete unfairly by flooding the market with infringing products.”
